– Pursuant the illegality of the annexation of Kabylia to French Algeria, which is not attested by any act of surrender or capitulation of Kabylia, neither in 1857 nor in 1871,

– Pursuant the war of liberation of Kabylia against Algeria, conducted from 1963 to 1965 and which had not issued any act of surrender or surrender of Kabylia,

– Pursuant the birth of the Kabylian Provisional Government (ANAVAD, 01/06/2010),

– Pursuant the birth of the Official Journal of Anavad “Aɣmis Unṣiv”,

– Pursuant the consensual adoption of the National Anthem “Ass n Tlelli”,

– Pursuant the establishment of the Kabylian Information Agency “SIWEL”,

– Pursuant the election by universal suffrage of the Kabylian flag,

– Pursuant the establishment of the Kabylian parliament “the IMNI”,

– Pursuant the adoption by the Imni Aqvayli of the Kabylian constitution, welcomed with pride by the Kabylian people.

– Pursuant the adoption and circulation of the Kabylian  Identity Card,

– Pursuant the establishment of the High Economic, Social and Environmental Council (CESEK),

– Pursuant the redefinition of Kabylia’s external borders on the basis of a study by an ANAVAD/IMNI/CESEK joint commission,

– Pursuant  the birth of the High Council for the Security of Kabylia (17/01/2021),

– Pursuant that the 5th Congress of the MAK adopted the resolution to return to Kabylia, the State of which it was deprived by French and post-French Algeria,

– Pursuant the massive adherence, many times affirmed, of the Kabyle people, to the project of self-determination and independence of Kabylia,

– With a view to the independence of Kabylia and to establish itself as a person under international law,

After examination, amendments and adoption by the Imni Aqvayli in plenary on Saturday: March 30, 2024,

The President of the Kabylia Provisional Government, Anavad, proclaims:

Article 1

By this law, on April 20, 2024 at 6:57 p.m., in Kabylia, on behalf of the Kabylian people, I proclaim the return to life and for eternity, of the Kabylian State/ Awanek Aqvayli, on the national and international scene.

Article 2

The Kabylian State has the legal personality of international law.

Article 3

The Kabylian State is the legitimate representative of the Kabylian people in Kabylia and around the world. It is the emanation of the will of all those who campaign for its advent.

Article 4

The Kabylian  State has its own funds from contributions and donations from Kabylia’s citizens and international institutions.

Article 5

The Kabylian State is working to organize the self-determination referendum of the Kabylian people.

Article 6

It is embodied by a president elected by the MAK convention, responsible to the Kabylian people and their institutions.

Article 6-1

The president of the Kabylian State  is assisted by a Vice-President who is appointed on the same  basis as the Prime minister and his government.

Article 6-2

The president of the Kabylian State holds interim meetings with the Parliament (IMNI) to which he reports the work done as part of his missions.

Article 7

No one is entitled to question this proclamation for any reason whatsoever, even after the independence of Kabylia.

Article 8

All institutions of the Kabylian State are bound, each as far as it is concerned, by the execution of this Proclamation.

Article 9

This law proclaiming the rebirth of the Kabylian State is published in the Official Journal of Anavad.

Article 10

This proclamation is addressed to all governments sitting in the UN, supranational organizations and partners of the Kabylian people.
